NOOSA WEDDING & EVENTS TERMS & CONDITIONS

Terms and Conditions Definitions
a) ‘Customer’ refers to person, company or firm, or any person authorised or employed by said company or persons who enters into this agreement on behalf of the Customer.
b) ‘Equipment’ means the goods specified on the Hire Quotation and Booking Agreement.
c) ‘Supplier’ means Noosa Wedding and Events, its employees and agents.
Hire Quotation and Booking Agreement
Quotations and pricing is valid for 30 days or until written confirmation and 50% deposit/booking fee is received. Equipment is not reserved until written confirmation and deposit/payment is received. Deposit/booking fees are not refundable; a 50% non-refundable deposit/booking fee is required to offer you (the client) and Noosa Wedding and Events security. By paying your deposit/booking fee, the items you have requested will be held for you only on your event date, Noosa Wedding and Events will make those items unavailable to other clients once your booking fee is received. The Hire Quotation and Booking Agreement is a quotation only and that the pricing provided may vary subject to availability of Equipment. This quotation does not include accommodation, or any Equipment or services not listed within the Hire Quotation and Booking Agreement. The Customer acknowledges that this rental is subject to the terms and conditions of the Noosa Wedding and Events Agreement. In particular, that additional charges will be incurred for late returns, dirty, or damaged Equipment. Equipment not returned will be regarded as stolen. If for any reason items need to be restyled due to weather or other unforeseen events – Noosa Wedding and Events reserve the right to charge a fee for extra styling/time. Failure to pay these charges in accordance with these terms will incur interest amount owing at 2.5% per month from the due date of payment and calculated on a daily basis, together with any costs incurred by Noosa Wedding and Events in recovering the amount owing, including but not limited to all legal costs and collection agency fees.
Confirmation and Payment
To confirm your booking and reserve the Equipment, Noosa Wedding and Events requires either payment in full or a non-refundable deposit of 50% of the total amount of your booking. The balance of the amount owing is due 2 weeks prior to the event date. Bookings made within 2 weeks of commencement date do not require a deposit, payment must be made in full.
Final Details
Equipment, numbers and final details must be finalised 1 month prior to commencement date of your event. No changes may be made after this date. If required additional Equipment may be hired if available and invoiced separately for payment. Please check your final proposal carefully to ensure that your requirements are correct.
Cancellation Fee
If the Customer cancels the hire for any reason, including weather or pandemic event, prior to one month before the event, payments will be refunded less the original 50% deposit. If Customer cancels hire for any reason, including weather or pandemic event, within two weeks of commencement date of event, a cancellation fee of 75% of total invoice will be charged. If hire is cancelled after delivery and set up of Equipment, full payment will be retained. Refunds will be at the discretion of Noosa Wedding and Events management. If Supplier is unable to supply Equipment quoted for any reason, a suitable replacement will be provided instead. In the unlikely case of a suitable replacement not being available, it is at management’s discretion to provide either credit or refund.
Postponements
In the event of natural disasters, pandemics or government restrictions, which prevent Noosa Wedding and Events from operating as normal due to events, limitations and restrictions out of our control, we will work with you to find a solution. Each situation will be accessed individually, and postponements may be offered in these circumstances subject to availability. postponements will be treated as follows:​

Postponements must be used within 12 months of original date, or all payments and event will be forfeited

If an event is cancelled after an approved postponement, no refunded is given.
Wet Weather
In the event of bad weather, we will do our very best to accommodate. However, if it is too windy for the arbours, or any risk of damage to our items, we reserve the right to refuse using them in unsafe circumstances. A back up wet weather plan MUST be organised well in advance. If Noosa Wedding and Events feel there is too much risk of our items getting wet or damaged, we have the right to refuse setting them up until an alternative dry location can be arranged. Unused items due to weather will not be refunded. In the event of wet weather - wet weather plans must be in place prior to Noosa Wedding and Events setting up. Noosa Wedding and Events will not relocate items once they are set up if you change your mind.
Use of Equipment
When Customer is to erect hire Equipment, the Customer acknowledges that they have received adequate instruction on the correct use of the Equipment, which includes demonstration, or verbal, or written instruction. Equipment must be used for purpose intended. The Customer accepts full responsibility for the care and use of the Equipment during the period of hire. The Customer is responsible for the provision of adequate security 24 hours a day to prevent theft and and/or damage to the Equipment from arrival on site to its return. In the event of rain – all our items must be moved undercover.
Bond when Customer is erecting hire Equipment
A REFUNDABLE bond will be required two weeks prior to the event to account for any loss or damage during the event. The amount of bond required depends on the value of the item which is being hired. We will advise you of the amount of bond required for your booking when we provide you with our quotation. This bond will be returned in full after the event, if no breakage, loss or damage has occurred. However, if items are returned unclean, wet, broken or substantially damaged, the hirer will forfeit the bond to the owner. Noosa Wedding and Events reserves the right to bill the client if substantial loss or damage occurs above the bond reserve. Refund of the bond is solely at the owner’s discretion. Refund of the bond will be by direct bank deposit within 14 days of the function. All items are to be returned clean and dry unless otherwise arranged. Unused hired items cannot be refunded.
Faulty or Missing Equipment
The Customer is responsible for any loss or damage to the Equipment during the period of hire. In the event of breakdown of, faulty or missing Equipment the Customer must notify Noosa Wedding and Events immediately. Where such a claim is admitted Noosa Wedding and Events must be given the opportunity to inspect the Equipment prior to the commencement of event. Noosa Wedding and Events will endeavour to either repair or replace Equipment within 2 hours of call out. If this process is not followed, faulty or missing Equipment claims admitted post-event may not receive full refund. The Customer shall not attempt to repair, replace, substitute, or alter the Equipment without Noosa Wedding and Events prior consent. If Equipment is found to be faulty due to Customer misuse, the Customer will be liable for the repair costs and call out fee of $80.00. If an item is unreturned, broken or damaged beyond repair, payment of full replacement value is required within seven days. If an item is returned damaged but repairable, you will be sent an invoice for the cost of repairs and payment is required within seven days. The hirer acknowledges that they are aware of the proper use for which the goods are designed, have inspected the goods, and agree that the goods are in clean condition, good working order and fit for the purpose of the event.
At Noosa Wedding and Events, we understand that some breakages can be unavoidable. However, any discrepancy, breakage, loss or damage MUST be brought to our attention upon conclusion of the event. It is the hirer’s responsibility to check ALL of the Equipment upon receipt. All Equipment is thoroughly checked, counted, and cleaned prior to delivery or collection from our premises. Any discrepancies or dissatisfaction must be brought to our attention in writing no later than 24 hours after the event.
Equipment and decorations remain the property of Noosa Wedding and Events. All items/hired goods are to be used for their designed purpose only. Noosa Wedding and Events accepts no responsibility or liability for damage to property or persons from the use of the hired Equipment and items once they have left our place of business.
Cleaning Fee
For safety of our staff, and also to adhere to health and hygiene guidelines, all hired Equipment must be rinsed of all food and beverage. This includes but is not limited to cutlery, crockery, glassware, bain maries and other catering Equipment. Please ensure Equipment is properly packaged and safely transported. Breakages, missing and damaged items must be paid for in full. We do not accept any substitutions. Any non-removable marks found will be charged for the cost of replacement. The Customer is not entitled to any refund of the price if items are returned unused or early. A cleaning fee will apply at $100.00 per hour if items are not returned to our satisfaction. Items that are not returned to our satisfaction will be professionally cleaned and an invoice will be issued to you for payment within seven days.
Linen
Hire of linen and material items, including tablecloths and serviettes, includes cost of professional laundering. Do not wash items prior to return. Ensure linen and material items are dry, clean from loose food, dust, decorations, mildew, tears, cuts, burns – sparkler splatters, candle wax, cigarettes, flowers, writing or pen marks, glitter/confetti etc. and stored in linen bags provided by Noosa Wedding and Events. Linen must not be placed in plastic bags as it may be attacked by mildew and will then be chargeable at the full replacement cost. Items which have been permanently stained or damaged will be charged for full replacement cost. This includes, but is not limited to, stains and damage caused from ink, wet crepe paper, flowers, confetti, coloured candles and candle wax, vomit, grease marks, mud, concrete dust and other permanent damage to fabric. Our linen MUST NOT be left outside overnight, if the hirer agrees for the times to be collected the following day. After the event, the items must be stored in a clean, dry undercover location.
Vintage Lounges
Our vintage lounges must be returned in the same condition as hired. DRINKS and FOOD and SMOKING, CANDLES and SPARKLERS are prohibited on the lounges at any time. The lounges are to be used for photo props only. These lounges are very expensive, and any damage during the hire, will be the full responsibility of the hirer. They must be stored under cover overnight.
Peacock Chairs
Our peacock chairs are very expensive and delicate. Strictly one person per chair. The arms of the chairs are not designed to bare weight. In the event that the chairs need to be moved, they are to be carried by the spine. Garlands/flowers are prohibited from being strapped to the chairs unless discussed and done so by a Noosa Wedding and Events team member. These peacock chairs are very expensive, and any damage during the hire, will be the full responsibility of the hirer. They must be stored under cover overnight.
Garlands and artificial floral arrangement
Unless otherwise specified, our floral arrangements are made from high quality artificial flowers. Our garlands and floral arrangements may vary in length, thickness and design. They are all one of a kind. Garlands and artificial floral arrangements MUST NOT be used near any FLAMES. Where garlands and artificial floral arrangements are used, real candles are prohibited, unless secured in glass pillars however LED candles can be used as a replacement. As the garlands and artificial floral arrangements are made out of synthetic material, they can easily catch on fire, which can cause damage to the venue, a person or melt our garlands. Noosa Wedding and Events will be held blameless if flames are used and damage is caused as a result of this. Our garlands and floral arrangements MUST NOT be left outside overnight, if the hirer agrees for the times to be collected the following day. After the event, the items must be stored in a clean, dry undercover location.
Aisle runners, mats, rugs, throws and cushions
Smoking is prohibited on our aisle runners, mats, rugs, throws and cushions. Any damage due to spills and burns will need to be fully paid for. Aisle runners, mats, rugs and throws are not to be used on wet ground or in wet weather. Do not attempt to wash items yourself prior to return. All aisle runners, mats, rugs, throws and cushions must be returned clean and dry. All items must be free from dirt, decorations, mildew, tears, cuts, burns, including sparkler splatters, candle wax, cigarettes, writing or pen marks, glitter/confetti etc. Items which have been permanently stained or damaged will be charged at full replacement cost. This includes, but is not limited to, stains and damage caused from ink, wet crepe paper, rose petals, confetti, coloured candles and candle wax, vomit, grease marks, mud, concrete dust and other permanent damage to fabric. After the event, the items must be stored in a clean, dry undercover location.
Cutlery, Plates and Glassware
Hire of our cutlery, plates and glassware includes cost of cleaning – do not wash items prior to return. Please ensure, however, that cutlery, plates and glasses are free from loose food.
Candles
Our wax LED candles must not be stored and exposed to full sun, as they will melt and lose their shape. They must be stored in a cool dry location. Candles must be turned off once the event is over. REAL candles can ONLY be used in glass pillars when near runners, rugs or our artificial garlands. If real candles are used in glass pillars, our glass pillars must come back wax free, or we will need to charge a dewaxing fee. Tables and tablecloths must also be returned wax free.
Arbours
Our arbours MUST be secured to, or pegged into, the ground at all times when assembled. Arbours cannot be moved once secured. If you require an arbour to be moved, it must be prior arranged with Noosa Wedding and Events. Many of our arbours are heavy and delicate and are not to be moved by unauthorised personal under any circumstance. Many of our arbours cannot be used in wet weather, and an undercover option must be provided. In the event that our arbours are exposed to high winds, we reserve the right to refuse set up.
Tables
Our hardwood trestle tables must be transported using padding. Tables are to be returned clean, wax, stain and dent free.
​Fires and Heaters
Fire pits and braziers must not be used within 6m from Noosa Wedding and Events Marquees and soft furnishing - lounge suites, cushions, mats, curtains, draping, etc. Ash, embers and smoke can cause severe damage Bonfires are not to be used within 20 metres of any of our hire items. Items returned smelling of smoke will incur extra cleaning charges. Gas heaters cannot be used with our marquees, unless approved by Noosa Wedding and Events. Sparklers cannot be used at any time under our Marquees. Candles must be enclosed in glass pillars on tables to be approved for use with our marquees.

Marquees
Access to site via vehicle must be provided. Site must be flat level ground, free from flooding. Site must be grassed and mowed. We will not set up on dirty or muddy areas. In the event that a marquee is to be set up on concrete, this needs to be discussed early in the planning. The site must be free of any overhead restrictions, overhanging tree branches and powerlines.
Delivery of Equipment
When Noosa Wedding and Events is delivering Equipment, the time of delivery and collection of Equipment will be agreed upon prior to commencement of hire. Where possible, the Customer shall be on site when Noosa Wedding and Events delivers and collects the hired Equipment. If Customer is not on site specified at time of delivery or collection, Noosa Wedding and Events shall unload or load Equipment in your absence. Our assessment of quantities and condition of hired Equipment delivered or collected by Noosa Wedding and Events in Customer’s absence shall bind Customer. If the Customer has erected the hire Equipment themselves, the Customer agrees to stack hired Equipment ready for collection on site, specified in schedule, at a position which is readily accessible to collection vehicle. Where possible, the Customer will provide vehicle and trolley access so as to facilitate the loading and unloading for all hired goods. A distance of no more than 25 metres from carpark to set up location must be allocated. Long distances, or difficult access must be discussed early in planning so that appropriate timings and plans can be implemented. Failure to bring such issues to our attention will incur fees. Parking for a long van and trailer must be allocated. The Customer must advise of any unusual delivery conditions, ie. dangerous dogs, steep driveways, stairs, etc. If we are not advised of these conditions in advance, and are unable to deliver the items on the day, due to physical circumstances, there will be no refund or credit of items.
Conditions of Site
When Supplier is to erect hire Equipment, the hirer will give Supplier full and accurate details of all underground obstructions and rock base, and/or all installations for electricity and water and gas drainage, and other things in/or under site at which hired Equipment is to be erected by Supplier, when such erection is part of the hire contract. If hirer fails to properly inform Supplier, or misinforms Supplier, then hirer shall be solely liable for all damage resulting therefrom. If hirer’s failure to properly notify results in delay in erecting hired Equipment, additional erection time shall be paid for by hirer to Supplier at rate of $55.00 per hour per staff member on site.
Interruptions on Site
Should Noosa Wedding and Events staff be interrupted or delayed in their delivery or setup/collection of Equipment due to delays or interruptions caused by the Customer or their representatives, suppliers, venue, contractors or agents, Noosa Wedding and Events may charge a stand down fee at the rate of $55.00 per hour per staff member on-site until they can resume work.
Indemnity
The Customer agrees to indemnify the Supplier from and against any claim, action, proceeding, judgement, damage, loss, cost, expense or liability whatsoever incurred or suffered by or brought or made or recovered against this Supplier to the extent that the same arises or is connected with or all actions by the Customer, its representatives, partners or agents and any or all of its third party contractors or Suppliers, except where such loss liability results from the negligence (error or omission) of the Supplier, their officers, staff, servants or agents. The Customer will be liable to the Supplier regardless of any other contractual arrangements that they have entered into with third parties, either known or unknown to the Supplier, except where such loss liability results from the negligence (error or omission) of the Supplier, their officers, staff, servants or agents. (The Supplier recommends that all contractors, riggers, staging and roofing companies be required to hold full and comprehensive insurance. It is in the Customer’s best interests to have sight of such policies from the commencement of the event).
Acceptance of Quote
Payment of the 50% deposit/booking fee to the Supplier deems acceptance by the Customer of these Terms and Conditions of Hire. In the event that Equipment or services are provided by the Supplier prior to receiving the agreed 50% deposit/booking fee, the absence of any written objection to such provision shall be deemed acceptance of the Terms and Conditions of Hire as set out above. Any payment made towards booking shall also be deemed acceptance of the terms and conditions. The laws of Queensland, Australia, shall govern the terms and conditions of this agreement.
